This Privacy Policy is for all visitors to our website who provide any personal information to us.  The definition of Privacy we follow is the rights and obligations of individuals and organizations with respect to the collection, use, retention, disclosure, and disposal of personal information.  Personal information (sometimes referred to as personally identifiable information) is information that is about, or can be related to, an identifiable individual. It includes any information that can be linked to an individual or used to directly or indirectly identify an individual. Individuals, for this purpose, include prospective, current, and former customers, employees, and others with whom we have a relationship.

How we collect and retain personal information

We may receive personal information about you through your use of any of the following contact and messaging methods through our website.

Our website includes a “Contact Us” page where you may locate our telephone number, email address and a contact form that anyone may complete and send.  We also maintain a blog which allows interactive comments to be posted by visitors to our website.

As of April 9, 2014, we also operate the SCF Suite as a service to investors and integrators that have successfully applied for, been offered, and have accepted membership.  The terms of use and service applicable to the SCF Suite are not applicable to all visitors to our website, but this Privacy Policy is incorporated into those term of use and also applies to all users of the SCF Suite.

In addition to your inputting and sending your name, address, email address and other personal details through any of the features or methods described above, our network servers also log automatically hostnames and IP addresses. In addition, we may also collect information relating to your use of our website through the use of various technologies, including cookies.

Like most website operators, SCF collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. SCF’s purpose in collecting non-personally identifying information is to better understand how SCF’s visitors use its website. From time to time, SCF may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

SCF also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on its blog. SCF blog commenter IP addresses and email addresses are visible and disclosed to the administrators.

We retain and store personal information on network servers located in the United States. The SCF Suite is regularly scanned to identify common vulnerabilities. The Suite was configured to meet the requirements of most third party accounting platforms.  The SCF Suite is hosted using an Amazon cloud server. The SCF Suite SSL has been configured to support only SSL version 3 and HTTPS is enforced on all pages. Insecure HTTP methods (DELETE, OPTIONS, PUT, HEAD and TRACE) are disabled. There are no Cross Site Request Forgery Vulnerabilities, Cross Site Scripting Vulnerabilities, SQL injection vulnerabilities, or XML Injection Vulnerabilities.

The SCF Suite does not allow access to user application data to any external APIs. The SCF Suite does not export, save, or store application data for any other purposes other than the functional use of the application.

Application source code and sensitive information are not exposed in a query string, log or error message within the application.

How we use or disclose personal information

We collect your personal information for various purposes, such as processing your registration with us, corresponding with you, providing you with a service, marketing our service offerings to you, customer satisfaction surveys, or in connection with a job application.  We may combine the information we collect from you with information obtained from other sources to help us verify or improve its overall accuracy and completeness, and to help us better tailor our interactions with you.

This site uses cookies to store information on your computer.  Some are essential to make our site work; others help us improve the user experience. By using the site, you consent to the placement of these cookies.  You may also turn off cookies in your browser, but then our site may not operate or navigate as smoothly for you.

We do not currently share personal information with any companies, whether or not affiliated with SCF, for purposes of their general marketing of products and services to you.  If that changes in the future we will update our Privacy Policy and notify you in advance of the effective date of the change so that you have an opportunity to opt out.

We do utilize Google Analytics on all web properties. Google Analytics is a web analysis service provided by Google. Google utilizes the data collected to track and examine the use of sustainablecapitalfinance.com, to prepare reports on its activities and share them with other Google services.

Google may use the data collected to contextualize and personalize the ads of its own advertising network.

If you have provided any personal information in connection with your use of the SCF Suite, whether in the member’s profile or in any project information or documentation, we may share that personal information with other members and users of the SCF Suite for the purposes and in accordance with the terms of use applicable to the SCF Suite.

How we dispose of personal information

After we no longer need personal information to fulfill our purposes for which it was collected and retained, we will destroy or erase it according to established U.S. privacy industry guidelines in effect at that time.  We will also destroy or erase any of your personal information if you request us to do so in writing and you will no longer be using our website.

Dispute resolution

We generally prefer to resolve disputes without a formal legal case. Before filing a claim against SCF, you agree to try to resolve the dispute by contacting dispute-notice@scf.com. We’ll contact you via email, and together we’ll try to resolve the dispute informally.  If the dispute is not resolved within 30 days of your first email, you or SCF may bring a formal proceeding.

Unless you opt out, you and SCF agree to resolve any claims relating to your use of our website or services through final and binding arbitration.  You can decline this agreement to arbitrate by sending us an email with the words “Opt Out of Arbitration” to dispute-notice@scf.com within 30 days of your first use of our site after April 9, 2014, the date we posted this Privacy Policy including our dispute resolution process.

The American Arbitration Association will administer the arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes, if applicable. The arbitration will be held in San Jose, California, or any other location SCF agrees to.

You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed.

In the event that you opt out or the agreement to arbitrate is found not to apply to you or your claim, you and SCF agree that any judicial proceeding will be brought either in small claims court, if the amount in controversy is low enough, otherwise in the federal or state courts of Santa Clara County, California. Both you and SCF consent to venue and personal jurisdiction there.
